By accessing our website or engaging our freight forwarding, ocean freight, air freight, customs clearance, or import/export services, you agree to these terms. 📜 1. Acceptance of Terms

Falcon Global Logistics ("Company", "we", "us", "our") provides logistics and freight forwarding services subject to the following Terms of Service ("Terms"). By visiting our website (www.falcongl.com, including all subpages) or submitting any inquiry, quote request, or service agreement, you acknowledge that you have read, understood, and agree to be bound by these Terms. These Terms constitute a legally binding agreement between you ("Client", "User", "you") and Falcon Global Logistics. Any additional or different terms proposed by you are expressly rejected unless we agree in writing.

🚛 2. Logistics Services Description

Falcon Global Logistics specializes in international freight forwarding, including but not limited to: ocean freight (FCL/LCL), air freight, import/export documentation, customs clearance, project cargo handling, and warehousing coordination. The specific scope of services for any shipment shall be defined in a separate Service Agreement, Bill of Lading, or written confirmation issued by us. No verbal promises or representations shall be binding unless confirmed in writing by an authorized representative of Falcon Global Logistics. We reserve the right to refuse any shipment that violates applicable laws or presents unreasonable safety risks.

We act as a freight forwarder and not as a carrier. Our responsibility is to arrange transportation with third-party carriers (shipping lines, airlines, trucking companies). All carriage is subject to the terms and conditions of those underlying carriers, including limitations of liability under international conventions (e.g., Hague-Visby Rules, Montreal Convention).

💰 3. Quotations & Pricing

All quotations provided by Falcon Global Logistics, whether via our website quote form, email, or phone, are estimates based on the information you provide. Quotations are valid for 15 days from the date of issue unless otherwise stated. Actual final charges may vary due to factors beyond our control including, but not limited to: fuel surcharges, currency fluctuations, port fees, customs duties, demurrage, detention charges, and changes in cargo specifications. Any taxes, customs duties, or government levies are the sole responsibility of the Client. We will endeavor to notify you of any material changes before proceeding, but you agree that final invoices may reflect actual incurred costs. Payment terms: invoices are due within 15 days of issue unless credit terms have been explicitly granted. Late payments may incur interest at 1.5% per month and collection costs.

📦 4. Client Responsibilities

You agree to provide accurate, complete, and lawful information regarding your shipment, including: proper cargo description, weight, dimensions, hazardous nature (if any), and all export/import documentation. You are solely responsible for compliance with all applicable laws, sanctions, and import/export regulations of both origin and destination countries. You warrant that your cargo does not contain prohibited items (e.g., illegal substances, counterfeit goods, weapons, hazardous waste). Falcon Global Logistics reserves the right to inspect any shipment (at your expense) to verify compliance. You shall indemnify and hold us harmless from any fines, penalties, losses, or damages arising from your failure to comply with these responsibilities.

⚖️ 5. Limitation of Liability

To the maximum extent permitted by law, Falcon Global Logistics' total liability for any claim arising out of or relating to our services (whether in contract, tort, negligence, or otherwise) shall be limited to the lesser of: (a) the total freight charges paid by you for the specific shipment giving rise to the claim, or (b) USD 500 per shipment. We shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profit, loss of revenue, loss of market, or damage to reputation, even if advised of the possibility of such damages. Our liability for cargo loss or damage is further limited by international conventions applicable to the underlying carrier (e.g., Hague-Visby limits of approximately USD 666 per package). Clients are strongly encouraged to obtain their own cargo insurance to cover full value.

🌊 6. Force Majeure

Neither party shall be liable for delays or failures in performance resulting from causes beyond its reasonable control, including but not limited to: acts of God, war, terrorism, civil unrest, strikes, embargoes, port closures, pandemic, governmental actions, natural disasters, severe weather, or equipment failures. In the event of force majeure, we will make reasonable efforts to reroute or store cargo, but any additional costs shall be borne by the Client. If the force majeure event continues for more than 30 days, either party may terminate the affected service agreement without penalty.

💻 7. Website Use & Intellectual Property

Our website (including all text, graphics, logos, images, and software) is the property of Falcon Global Logistics and protected by copyright and trademark laws. You may access and browse the website for personal, non-commercial use to learn about our logistics services. You are prohibited from: copying, reproducing, distributing, modifying, creating derivative works, reverse-engineering, or scraping any content without prior written consent. Any unauthorized use may result in legal action. The website is provided "as is" without warranties of uninterrupted access, error-free operation, or accuracy of third-party content (e.g., unsplash images). We do not collect any tracking data or cookies as detailed in our Privacy Policy. However, we reserve the right to suspend or restrict access to our website for maintenance, security, or legal reasons.

🏛️ 8. Governing Law & Dispute Resolution

These Terms and any disputes arising from your use of our services or website shall be governed by and construed in accordance with the laws of the Islamic Republic of Pakistan, without regard to conflict of law principles. The exclusive jurisdiction and venue for any legal proceeding relating to these Terms shall be the courts of Karachi, Pakistan. For any dispute, claim, or controversy arising out of these Terms or our services, the parties shall first attempt to resolve the matter through good-faith negotiations. If unresolved within 30 days, either party may submit the dispute to binding arbitration under the Rules of the Karachi Centre for Dispute Resolution (KCDR), with arbitration held in Karachi and conducted in English. The arbitrator's award shall be final and binding, and judgment may be entered in any court of competent jurisdiction. Notwithstanding the foregoing, either party may seek injunctive relief in court to protect its intellectual property or confidential information.

Falcon Global Logistics reserves the right to update or modify these Terms of Service at any time without prior notice. The most current version will be posted on this page with the "Last Updated" date at the top. Your continued use of our website or services after any changes constitutes acceptance of the revised Terms. For significant changes, we may provide additional notice via email or website banner.
